Succinct ZCAM App - Terms of Service

Effective Date: March 2, 2026

These Terms of Service (“Terms”) govern your access to and use of the Succinct ZCAM mobile application, the ZCAM website, and related services (collectively, the “Service”), operated by Succinct Labs Inc. or its affiliates (“Succinct,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

  1. Nature of the Service

The Service allows users to capture images and videos using a zero-knowledge proof system that cryptographically attests to certain properties of the capture process (such as device make and model, software version, and camera parameters) and, at the user's election, to publish such content and associated metadata on the public ZCAM website.

The Service verifies technical provenance only. It does not verify ownership, copyright, consent of depicted persons, legality, or factual accuracy of the content.

  1. User Content and Licenses

You retain ownership of any photographs, videos, text, or other content you upload to the ZCAM website (“User Content”). By uploading User Content, you grant Succinct a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and make available such User Content solely for the purpose of operating and providing the Service.

  1. Representations and Warranties

You represent and warrant that:

(a) You own or have all necessary rights, licenses, and permissions to upload and publicly display the User Content;

(b) Your User Content does not infringe any copyright, trademark, privacy, publicity, or other proprietary right;

(c) All persons depicted have consented to the capture and public display of the User Content; and

(d) Your User Content complies with all applicable laws and these Terms.

  1. Prohibited Content

You may not upload, publish, or share User Content that:

  1. Infringes intellectual property rights;
  2. Is defamatory, fraudulent, or misleading;
  3. Contains sexual exploitation of minors or otherwise constitutes child sexual abuse material (“CSAM”);
  4. Depicts non-consensual intimate imagery;
  5. Contains extreme violence, gore, or terrorist propaganda; or
  6. Violates any applicable law or regulation.

Succinct reserves the right to remove any User Content at its sole discretion and to suspend or terminate accounts for violations.

  1. Content Moderation and Reporting

Users may report prohibited or unlawful content through reporting tools on the ZCAM website or at legal@succinct.xyz. Succinct will investigate reports and may remove content, disable access, and notify appropriate authorities, including the National Center for Missing and Exploited Children where required by law.

  1. Copyright and DMCA Policy

Succinct respects the valid intellectual property rights of others. You must ensure that the materials you share on the ZCAM website do not infringe any third-party rights, including, without limitation, copyrights. It is our policy to respond to clear notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (“DMCA”).

  1. DMCA notice of alleged infringement

If you believe that any content made available on the ZCAM website infringes a copyright you own or control, you may submit a written notification of claimed infringement to our designated copyright agent with the following information (as required by 17 U.S.C. § 512(c)(3)):

  1. Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works;
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (such as a URL or in-app identifier);
  3. Your contact information, including address, telephone number, and email address;
  4. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  5. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf; and
  6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf

We may remove or disable access to allegedly infringing material and may notify the user who posted the content of the removal.

  1. DMCA counter-notice

If you believe that content you posted on the ZCAM website was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our designated copyright agent at the details outlined above. The counter-notification must include (as required by 17 U.S.C. § 512(g)(3)):

  1. Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled;
  2. A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  3. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the Northern District of California), and that you will accept service of process from the person who provided the original DMCA notice or an agent of that personal; and
  4. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we may forward it to the original complainant and, unless the complainant files an action seeking a court order, may restore the removed content within the time period required by law.

  1. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Succinct has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also limit access to the Service for users who repeatedly upload content that infringes the intellectual property rights of others.

  1. Privacy and Metadata

Your use of the Service is subject to our Privacy Policy, which describes how we collect, process, and display personal data and device metadata. By publishing content publicly, you acknowledge that associated metadata may also be visible and accessible to third parties.

  1. No Professional or Evidentiary Use

The Service is provided for general informational and social sharing purposes only. Succinct does not warrant that any verification output is suitable for legal, forensic, journalistic, or evidentiary use.

  1. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUCCINCT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR REPUTATION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

  1. Indemnification

You agree to indemnify and hold harmless Succinct from any claims, damages, liabilities, and expenses arising out of your User Content or your violation of these Terms.

  1. Termination and Suspension

Succinct may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms or applicable law.

  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of laws principles.

  1. Changes

We may modify these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
